Terms of use
The agreement between you and Arrivo for using our app and website.
The short version
- Arrivo is a platform for families to care for and stay in touch with each other. It helps you share and communicate; it is not a safety or emergency service.
- Only share with people who agree. Never use Arrivo to track anyone without their knowledge.
- Arrivo is not an emergency service. In an emergency, call 995 or 999 first.
- Locations can be late or wrong. Phones, signal and battery settings affect them.
- Paid plans are billed by the app store. Cancel any time in your store account.
- Singapore law applies.
1. About these terms
These terms are an agreement between you and Goldmend Studio, a company registered in Singapore, UEN 53534524X ("Arrivo", "we", "us") for your use of the Arrivo app, arrivofamily.com and related services (the "Service"). By creating an account or using the Service, you agree to these terms and to our Privacy policy.
2. Who can use Arrivo
You must be at least 13 years old to create your own account. If you are under 18, you may use Arrivo only with the permission of a parent or guardian, who accepts these terms for you. A child under 13 may use Arrivo only when a parent or guardian adds them to the family group, gives consent for them and stays responsible for their use.
3. Your account
Give accurate information and keep it up to date. Keep your phone and sign-in secure, and tell us at once at [email protected] if you think someone else has used your account. You are responsible for activity under your account.
4. Groups and consent
Arrivo is organised in groups. A group's admins can invite and remove members, manage places and buy a plan for the group. Members of a group can see each other's location and the information described in our Privacy policy. You may add or invite someone only if they know and agree that the group will see their location, or, for a child, if you are their parent or guardian. Every member can see who can see them, and can pause sharing or leave a group at any time.
5. Acceptable use
You agree not to:
- track, follow, monitor or stalk anyone without their knowledge and consent, or install Arrivo on someone else's phone without their agreement;
- use Arrivo to harass, threaten, control or harm anyone;
- break the law, or share content you do not have the right to share;
- send false SOS alerts or misuse emergency contacts;
- upload malware or anything designed to damage or disrupt the Service;
- try to access other groups' data or bypass security, plan limits or usage limits;
- copy, resell or reverse-engineer the Service, except where the law allows it.
6. Safety features and their limits
Arrivo only provides a platform for family members to share their location, care for each other and communicate. We do not monitor anyone, and we do not provide security, medical or emergency services. Arrivo is not an emergency service and does not replace calling 995 (ambulance and fire) or 999 (police). Location, arrival alerts, SOS, crash detection and driving reports depend on your phone, its settings, battery, signal, GPS and third-party services. They can be delayed, inaccurate or stop working, for example when a phone is switched off, out of battery or has background activity limited. Crash detection may miss a crash or report one that did not happen. Do not rely on Arrivo as your only way to keep someone safe, and keep your phone's settings as shown in the app.
7. Your content
You keep ownership of everything you create in Arrivo, such as notes, check-ins and messages. You give us a limited, worldwide licence to host, store, copy, process and display it only as needed to provide the Service for you and your groups. This licence ends when your content is deleted from our systems, as described in our Privacy policy.
8. Plans, subscriptions and billing
- Free and paid plans: the features and limits of each plan are shown in the app and on our Plans page.
- Who pays: paid plans are bought through Google Play or the App Store and billed to the person who subscribes.
- Free trial: new subscribers may get a free trial. Unless you cancel before it ends, the paid subscription starts automatically.
- Renewal: subscriptions renew automatically at the end of each monthly or yearly period until cancelled.
- Cancelling: cancel at any time in your Google Play or App Store account. The plan stays active until the end of the paid period, then the group returns to the Free plan.
- Refunds: payments are handled by the app store, and refunds follow its policies.
- Price changes: we will give notice before a new price applies to your subscription, as required by the app store.
9. Our intellectual property
The Service, including the Arrivo name, logo, design and software, belongs to us or our licensors. These terms give you a personal, non-transferable right to use the Service; they do not give you any other rights in it. If you send us feedback, we may use it without any obligation to you.
10. Third-party services
Arrivo relies on third-party services, such as app stores, map providers and hosting providers, and may link to other apps and websites, for example to get directions. Their own terms apply to them, and we are not responsible for them.
11. Changes to the Service
We are always improving Arrivo, so features may change, be added or be removed. If we make a change that significantly reduces what a paid plan includes, we will tell you in advance. If we ever decide to close the Service, we will give at least 30 days' notice.
12. Suspension and termination
You can stop using Arrivo and delete your account at any time. We may suspend or close an account that seriously or repeatedly breaks these terms, puts others at risk (for example by tracking someone without consent) or exposes us to legal liability. Where reasonable, we will warn you first and explain why.
13. Disclaimers
We work hard to keep Arrivo reliable, but the Service is provided "as is" and "as available". To the extent permitted by law, we do not promise that it will be uninterrupted, accurate, error-free or meet every need, and we exclude all implied warranties.
14. Limitation of liability
To the extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue, data or goodwill, or for any loss caused by a location, alert or SOS being late, inaccurate or not delivered. Our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid for Arrivo in the 12 months before the claim, or (b) S$100. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, or for fraud, and nothing affects your statutory rights as a consumer.
15. Indemnity
You agree to compensate us for reasonable losses and costs arising from your breach of these terms or your unlawful use of the Service, including using it to track someone without their consent.
16. Governing law and disputes
These terms are governed by the laws of Singapore. If you have a concern, please contact us first at [email protected] and we will try to resolve it informally within 30 days. If we cannot, the courts of Singapore have exclusive jurisdiction, except where consumer law gives you the right to bring a claim elsewhere.
17. App store terms
If you download Arrivo from the App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google have no obligation to provide maintenance or support for Arrivo and are not responsible for any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You must also comply with the app store's own terms of use.
18. Changes to these terms
We may update these terms from time to time. We will show the new date at the top of this page and, for important changes, tell you in the app at least 14 days before they take effect. If you keep using Arrivo after that, the new terms apply.
19. General
These terms and our Privacy policy are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right straight away, we do not give it up. You may not transfer your rights under these terms without our consent; we may transfer ours as part of a reorganisation, merger or sale. No one other than you, us and, as set out in section 17, Apple has any right to enforce these terms.
